1. Agreement to these Terms
These Terms of Service (“Terms”) govern access to and use of EngineForge, including the EngineForge website, customer dashboard, builder, deployment and update tools, hosted management tools, support services, and related software and features collectively referred to as the “Service.”
EngineForge is a Pennsylvania sole proprietorship (“EngineForge,” “we,” “us,” or “our”).
By creating an account, accepting these Terms, accessing the Service, deploying or updating a site, or otherwise using the Service, you agree to these Terms and any additional terms presented for a specific feature. If you use the Service for a company, organization, or other person, you represent that you have authority to bind that party, and “you” includes that party.
During the closed-alpha period, the Closed Alpha Understanding and Participation Addendum is incorporated into these Terms. If the Addendum conflicts with these Terms regarding an alpha-specific matter, the Addendum controls.
Our Privacy Policy explains how we collect, use, and disclose personal information.
2. Eligibility and authority
You must:
- Be at least 18 years old.
- Have legal capacity to enter a binding agreement.
- Use the Service only for lawful purposes.
- Provide accurate account information.
- Have authority to act for any organization, brand, site, person, character, or property represented through your account.
The Service is not intended for children or for sites directed to children. You may not use EngineForge to operate a service intended for anyone under 18 during the closed alpha without our prior written approval and appropriate age-assurance, parental-consent, privacy, and safety controls.
3. Accounts and security
You are responsible for maintaining the confidentiality and security of your account credentials, authentication methods, recovery information, connected provider accounts, API keys, hosting credentials, and devices.
You agree to:
- Use a unique and reasonably secure password.
- Protect any multifactor-authentication or recovery information.
- Promptly notify us of suspected unauthorized access.
- Keep account and contact information current.
- Ensure that anyone acting through your account is authorized.
You are responsible for actions taken through your account unless they result directly from EngineForge’s failure to use reasonable security measures.
We may require email verification, additional authentication, renewed legal acceptance, or other security steps before allowing high-risk actions such as deployment, updates, provider changes, ownership changes, or access to sensitive settings.
4. What EngineForge provides
EngineForge provides tools that may allow you to:
- Configure and build AI-powered sites and experiences.
- Select or create characters and related content.
- Connect third-party AI, hosting, authentication, email, payment, and infrastructure services.
- Generate text, images, and other output.
- Train or configure identity-related image models where available.
- Deploy sites to supported third-party hosting environments.
- Manage deployed sites and their users.
- Import, update, troubleshoot, or support deployed sites.
- Receive and respond to support tickets and alpha feedback.
Features, limits, providers, workflows, and compatibility may change. Some features may be experimental, unavailable, restricted, or removed.
5. Your sites and your responsibility as Site Operator
A site you create or deploy through EngineForge is your site, and you are its “Site Operator.”
As Site Operator, you are responsible for:
- The purpose, configuration, content, marketing, and operation of your site.
- Deciding what information your site collects and why.
- Providing accurate notices and obtaining any legally required consent.
- Moderating end-user content and generated output.
- Handling end-user support, complaints, disputes, refunds, and privacy requests relating to your independent activities.
- Ensuring your site and content comply with applicable law.
- Ensuring your use of third-party providers complies with their terms.
- Maintaining appropriate backups and business-continuity procedures.
- Determining whether generated output is suitable before publishing or relying on it.
- Any custom code, scripts, tracking tools, integrations, or modifications you add.
EngineForge may provide standard end-user Terms and Privacy language during the alpha. Those standard documents do not eliminate your responsibility to evaluate whether your specific business, content, jurisdiction, or data practices require additional disclosures or terms.
You may not describe EngineForge as the owner, operator, sponsor, employer, partner, or guarantor of your site unless we expressly agree in writing.
6. Customer Content
“Customer Content” includes text, prompts, instructions, images, files, characters, names, likenesses, branding, configuration, site content, user submissions, messages, support materials, and other information you or your end users submit through the Service.
As between you and EngineForge, you retain your rights in Customer Content.
You grant EngineForge a worldwide, nonexclusive, royalty-free license to host, copy, transmit, format, modify, display, and otherwise process Customer Content only as reasonably necessary to:
- Provide and operate the Service.
- Generate requested output.
- Deploy, update, and troubleshoot your site.
- Maintain security and prevent abuse.
- Provide support that you request or authorize.
- Comply with law and enforce these Terms.
EngineForge does not itself use Customer Content to train a general-purpose AI model unless you separately and affirmatively agree. Third-party AI providers may process prompts, uploads, or outputs according to their own terms, privacy policies, account settings, and data-retention practices.
You represent and warrant that:
- You own Customer Content or have all necessary permissions.
- Customer Content and its use through EngineForge do not violate law or another person’s rights.
- You have obtained any required consent from people depicted, named, recorded, impersonated, or otherwise represented.
- You will not upload confidential or restricted information unless you are authorized to do so and have determined that the Service is appropriate for it.
7. Identity training and likeness-based features
Identity training and similar features may use images to create a model or configuration associated with a person’s appearance.
You may use these features only when:
- Every depicted person is at least 18 years old.
- You own the images or have permission to use them.
- You have the depicted person’s express permission for AI identity training and generation.
- The resulting content will not be deceptive, exploitative, defamatory, or nonconsensual.
- You comply with applicable publicity, privacy, biometric, copyright, and other rights.
You may not use identity training to:
- Create sexual or intimate content of a real person without their express consent.
- Impersonate someone for fraud, harassment, political manipulation, or deception.
- Train on images of minors.
- Evade a provider’s safety policies.
- Create content that falsely represents a real person as endorsing a product, service, belief, or act.
Identity training uses connected provider accounts and can spend real money. Current planning estimates may state a minimum expected cost, but estimates are not guarantees. Provider pricing, retries, failures, model settings, and workflow changes may increase the actual cost. Charges made by providers are governed by their terms and are generally outside EngineForge’s control.
You are responsible for confirming the estimated cost and image permissions before beginning training.
8. AI-generated output
The Service may produce text, images, recommendations, summaries, classifications, and other AI-generated output.
AI-generated output may be:
- Incorrect, incomplete, inconsistent, biased, offensive, or misleading.
- Similar or identical to output generated for others.
- Unsuitable for publication or commercial use.
- Subject to third-party rights or legal uncertainty.
- Affected by model-provider policies, filters, outages, and changes.
You must independently review output before using, publishing, selling, or relying on it.
You may not rely on the Service or generated output as a substitute for qualified medical, legal, financial, mental-health, emergency, safety, or other professional advice.
You may not use EngineForge to make decisions that determine another person’s eligibility for employment, housing, education, credit, insurance, healthcare, public benefits, or other similarly significant opportunities unless we have expressly approved that use in writing and you have implemented legally required safeguards.
To the extent permitted by law and applicable provider terms, EngineForge does not claim ownership of output generated specifically for you. No ownership, exclusivity, noninfringement, or registrability of generated output is guaranteed.
9. Acceptable use
You may not use the Service to create, upload, distribute, facilitate, or promote:
- Child sexual abuse material or sexualized content involving minors.
- Human trafficking, sexual exploitation, or grooming.
- Nonconsensual intimate imagery.
- Credible threats, targeted harassment, stalking, or doxxing.
- Fraud, phishing, identity theft, deceptive impersonation, or scams.
- Malware, credential theft, unauthorized surveillance, or system intrusion.
- Terrorist activity or violent extremist activity.
- Instructions intended to enable serious physical harm.
- Illegal discrimination.
- Copyright, trademark, privacy, publicity, or other rights violations.
- Content or activity prohibited by a connected provider.
- Attempts to bypass safety controls, rate limits, access restrictions, or billing controls.
You may not:
- Access accounts, data, systems, or sites without authorization.
- Probe or test security except under a written authorization from EngineForge.
- Interfere with Service availability or impose unreasonable load.
- Reverse engineer the Service except where law expressly permits it.
- Resell or sublicense access except through an EngineForge-approved program.
- Conceal the origin of automated traffic.
- Use the Service for regulated, safety-critical, weapons-related, emergency-response, or mission-critical operations without our prior written approval.
- Submit Social Security numbers, complete payment-card details, protected health information, government secrets, or similarly sensitive data unless expressly supported and authorized.
We may investigate suspected violations, limit functionality, remove content, preserve evidence, or suspend access when reasonably necessary to protect users, EngineForge, third parties, or the public.
10. Third-party services and provider accounts
The Service depends on third-party products and services, which may include:
- Hosting and database providers.
- Authentication providers.
- AI and model providers.
- Image-generation and model-training providers.
- Email-delivery providers.
- Payment processors.
- Monitoring, security, storage, and networking providers.
You may connect your own accounts, credentials, or API keys. You remain responsible for:
- Your agreements with those providers.
- Provider charges and credit usage.
- Provider account security.
- Provider restrictions, suspensions, and limits.
- Maintaining sufficient balances, quotas, and permissions.
- Reviewing provider privacy and data-use terms.
Third-party services are not controlled by EngineForge. Their outages, policy changes, pricing changes, data practices, or termination of service may affect EngineForge or your deployed site.
EngineForge is not responsible for third-party fees, lost credits, provider refunds, provider account suspensions, or third-party service failures except to the extent directly caused by EngineForge’s willful misconduct.
11. Hosting, deployment, updates, and exports
EngineForge may package, export, deploy, or update software and configuration to a hosting account controlled by you or by a third-party provider.
You understand that:
- A deployment or update may create, change, migrate, restart, or replace hosted resources.
- Compatibility can be affected by provider changes, unsupported modifications, schema changes, custom code, or configuration drift.
- Availability depends partly on your hosting account and connected providers.
- You are responsible for hosting fees, domain fees, database fees, provider fees, and related expenses.
- You should maintain backups of important content and data.
- You should test significant changes before relying on them.
- EngineForge does not guarantee that every custom modification will survive an update.
You must not alter, remove, or bypass ownership, authentication, update-safety, security, or support controls in a way that creates unauthorized access or misrepresents the site’s state.
12. Support access and troubleshooting snapshots
EngineForge may request information to diagnose a support issue.
Where available, you may authorize a read-only troubleshooting snapshot of deployed site state. A support snapshot may include configuration, provider metadata, schema information, selected site content, operational state, and other information reasonably necessary to investigate the issue.
EngineForge will not request or import a support snapshot without the authorization required by the Service workflow.
A support snapshot does not, by itself:
- Modify your live site.
- Publish Builder changes.
- Migrate your site.
- Authorize EngineForge to operate the site on your behalf.
- Give EngineForge unrestricted or permanent access to your hosting account.
You are responsible for reviewing the request and determining whether the snapshot may contain information you are permitted to share.
13. Fees and payment
Closed-alpha access may be offered without an EngineForge subscription fee unless we separately tell you otherwise.
You remain responsible for third-party costs, including AI-provider, hosting, database, email, domain, payment-processing, and similar charges.
If EngineForge introduces paid plans or paid features:
- Pricing and material billing terms will be presented before purchase.
- Fees will apply prospectively.
- You authorize the applicable payment processor to charge the selected payment method.
- Taxes may be added where required.
- Unless otherwise stated or required by law, fees are nonrefundable once the applicable service has been provided or billing period has begun.
- Cancellation stops future renewal but does not reverse already incurred third-party charges.
Disputes involving a third-party provider’s charges must generally be handled with that provider.
14. Intellectual property
The Service, including EngineForge software, interfaces, workflows, documentation, designs, trademarks, branding, and platform materials, is owned by EngineForge or its licensors and is protected by intellectual-property laws.
Except for the limited right to use the Service under these Terms, no EngineForge rights are transferred to you.
You may not remove proprietary notices, misrepresent ownership, register confusingly similar branding, or use EngineForge trademarks without permission.
15. Feedback
You may provide suggestions, bug reports, ideas, feature requests, or other feedback.
You grant EngineForge a perpetual, worldwide, irrevocable, royalty-free right to use, modify, commercialize, and incorporate feedback without restriction or compensation. This does not transfer ownership of unrelated Customer Content.
Do not include third-party confidential information in feedback.
16. Confidential alpha information
During the closed alpha, you may receive nonpublic information about planned features, security controls, architecture, pricing, provider relationships, roadmaps, or unreleased software.
You agree to use reasonable care to protect information that is marked confidential or that a reasonable person would understand to be nonpublic.
You may not publicly disclose an uncorrected security vulnerability, access credential, private user information, or exploit instructions. Report security concerns privately to support@engineforge.dev.
This section does not restrict information that:
- Becomes public without your breach.
- You lawfully knew without confidentiality duties.
- You independently developed.
- You lawfully received from another source.
- You must disclose by law, after giving notice where legally permitted.
17. Suspension and termination
You may stop using the Service at any time.
We may suspend, restrict, or terminate access when:
- You violate these Terms.
- Your use creates security, legal, operational, or reputational risk.
- A provider requires us to restrict access.
- Payment obligations remain unresolved.
- The alpha program or Service is changed or discontinued.
- Continued access is not commercially or technically reasonable.
Where practical, we will provide notice and an opportunity to export available Customer Content, but we do not guarantee export availability after termination.
Sections that by their nature should survive termination—including ownership, payment obligations, confidentiality, disclaimers, limitations of liability, indemnification, and dispute provisions—will survive.
18. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE, CLOSED ALPHA, SOFTWARE, SUPPORT, GENERATED OUTPUT, DEPLOYMENTS, UPDATES, AND RELATED MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.”
ENGINEFORGE DISCLAIMS ALL EXPRESS, IMPLIED, AND STATUTORY WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, COMPATIBILITY, AND QUIET ENJOYMENT.
ENGINEFORGE DOES NOT WARRANT THAT:
- THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
- DATA OR CONTENT WILL NEVER BE LOST.
- GENERATED OUTPUT WILL BE ACCURATE, UNIQUE, SAFE, OR LAWFUL.
- DEPLOYMENTS OR UPDATES WILL SUCCEED.
- THIRD-PARTY SERVICES WILL REMAIN AVAILABLE.
- THE SERVICE WILL MEET A PARTICULAR BUSINESS, TECHNICAL, OR LEGAL REQUIREMENT.
Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.
19. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENGINEFORGE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES; LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, CREDITS, OR OPPORTUNITY; OR THE COST OF SUBSTITUTE SERVICES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ENGINEFORGE’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID DIRECTLY TO ENGINEFORGE DURING THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR
- ONE HUNDRED U.S. DOLLARS.
This limitation applies regardless of the legal theory and even if a remedy fails of its essential purpose.
Nothing in these Terms excludes liability that cannot legally be excluded.
20. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless EngineForge and its contractors from claims, damages, losses, liabilities, judgments, penalties, and reasonable legal expenses arising from:
- Your Customer Content.
- Your site or business.
- Your end users or your handling of their data.
- Your violation of law or these Terms.
- Your infringement or violation of another person’s rights.
- Your use of identity training, likenesses, or generated output.
- Your custom integrations, scripts, modifications, or provider accounts.
EngineForge will promptly notify you of a covered claim and reasonably cooperate at your expense. You may not settle a claim in a manner that admits wrongdoing by or imposes obligations on EngineForge without our consent.
21. Changes to the Service or Terms
We may modify the Service and these Terms.
For material changes, we may provide notice through the Service, by email, or through another reasonable method. We may require renewed acceptance before allowing continued access, deployment, updates, or other protected actions.
Changes apply prospectively from their stated effective date. Continued use after the effective date constitutes acceptance where permitted, but EngineForge may require an affirmative checkbox or other electronic acceptance.
22. Governing law and disputes
These Terms are governed by applicable federal law of the United States and the laws of the Commonwealth of Pennsylvania, without regard to conflict-of-law rules.
Before filing a legal action, each party agrees to make a good-faith effort to resolve the dispute informally for at least 30 days after written notice.
Unless applicable law requires otherwise, any legal action arising from these Terms or the Service must be brought in a state or federal court located in Pennsylvania. You consent to personal jurisdiction and venue in those courts.
Nothing prevents either party from seeking urgent injunctive relief to protect security, confidential information, or intellectual-property rights.
23. General terms
These Terms, the Privacy Policy, the Closed Alpha Addendum, and any applicable order or feature-specific terms form the complete agreement concerning the Service.
If a provision is unenforceable, it will be modified only to the minimum extent necessary, and the remaining provisions will continue.
Failure to enforce a provision is not a waiver.
You may not assign these Terms without our written consent. EngineForge may assign them in connection with a sale, transfer, reorganization, or succession of the business.
Neither party is liable for delay caused by events beyond reasonable control, excluding payment obligations.
Headings are for convenience only.
Electronic acceptance and electronic records have the same intended effect as signed paper records.
